  5. The Extended Lisp Function Library [ELF] ("the Software") is a computer
  6. program by Mountain Software designed to enhance AutoCAD. The ELF
  7. library provides the AutoLISP programmer with 16 utility and file
  8. management commands, and with over 190 additional functions for
  9. AutoLISP. The Software is designed to operate with AutoCAD 386 on
  10. IBM PC and compatible computers under the MS/PC-DOS operating system.

  12. Mountain Software is an Autodesk Registered Developer but otherwise is
  13. not affiliated with Autodesk, Inc. or its subsidaries.

  19. The Extended Lisp Function Library [ ELF ] program code, and ELF
  20. Reference Manual are both registered Copyrighted material by Jerome Lee
  21. Workman, jr., All Rights Reserved Worldwide.

  23. Shareware copies of ELF may be freely distributed subject to the
  24. restrictions detailed in the file VENDOR.DOC. Registered copies of ELF
  25. may not be copied or distributed, except as provided for in the License
  26. Agreement accompanying the registered version.

  29. License for ELF Software

  32. Your first use of ELF software constitutes your agreement to the following
  33. provisions:

  35. Shareware License:
  36.  
  37. A limited license at no charge is granted to use, test and duplicate the
  38. enclosed demonstration version of the Software for no more than 30
  39. calendar days. Thereafter, if you did not license the Software directly
  40. from Mountain Software, you must either pay the license fee to continue to
  41. use the Software or cease all use of the Software.

  45. Upon payment of the license fee, Mountain Software will grant a
  46. non-exclusive license to use the Software by one natural person
  47. regardless of whether the license is owned by the person or by a
  48. business (the "licensee"). Licensed copies of the Software may be kept
  49. only on computers actually used by the licensee. No purported transfer
  50. of the license shall be effective unless the person transferring the
  51. license (the "transferor")  (a) notifies Mountain Software of the name
  52. and address of the recipient of the license (the "transferee"), and (b)
  53. transfers all copies of the Software to the transferee, and (c) removes
  54. or destroys any other copies of the Software in the possession or under
  55. the control of the transferor.

  57. Runtime Distribution License
  58.  
  59. A runtime distribution license enables the licensee to distribute
  60. a special runtime version of ELF with their software product. You
  61. may distribute up to 100 (one hundred) copies of the ELF runtime
  62. file(s) as a component of a commercial software application.
  63. Developers may also purchase an unlimited license, terms must be
  64. negotiated with Mountain Software.

  66. Limited Warranty.
  67.  
  68. The Software is distributed and licensed on an "as is" basis. For a
  69. period of ninety (90) days from the date that you pay the license fees
  70. for the Software, you may return any disks and documentation provided by
  71. Mountain Software, and destroy all copies of the Software and the
  72. documentation that you have made, and you will receive a refund of the
  73. license fees that you paid to Mountain Software.

  75. Limitation of Remedies.
  76.  
  77. Should you encounter problems with the Software, Mountain Software's
  78. entire liability and your exclusive remedy shall be, at the sole option
  79. of Mountain Software, either (a) to terminate the license and return any
  80. license fees that you paid Mountain Software for the Software, or (b)
  81. repair or replace the Software.

  83. Disclaimer of Warranties.
  84.  
  85. Mountain Software make no claims as to the suitability of the Software
  86. for any specific use. Except for the Limited Warranty stated above,
  87. Mountain Software disclaims any and all other warranties, express or
  88. implied, oral or written, including any implied warranties of
  89. merchantability or fitness for a particular purpose. The limited
  90. warranty stated above gives you specific legal rights, but you may have
  91. other rights, which vary from state to state.

  93. Limitation of Liability.

  95. In no event shall Mountain Software be liable for any damages whatsoever
  96. arising out of the use of the Software, including without limitation any
  97. direct, incidental or consequential damages or any damages for loss of
  98. profits, business interruption, loss of information or any pecuniary
  99. loss even if Mountain Software has been advised of the possibility of
  100. such damages. Some states do not allow exclusion or limitation of
  101. liability for incidental or consequential damages, therefore the above
  102. limitation may not apply to you.
